Terms of Service
These Terms of Service ("Terms") govern your purchase of and access to the AlgoTrader NQGC service ("AlgoTrader", "the Service", "we", "us"). By purchasing a subscription, or by using our free indicators, you agree to these Terms.
1. What the Service is
AlgoTrader provides access to invite-only trading strategies ("Strategies") hosted on the TradingView platform, for CME futures such as NQ, MNQ and gold. Each Strategy applies fixed, published rules to price data and produces hypothetical entries and exits in TradingView's strategy tester, and, if you enable them, alert messages that you may route to your own broker through a third-party service.
The Strategies are general tools, identical for every subscriber and not tailored to your circumstances, objectives or account. They are not financial, investment or trading advice, and nothing we publish is a recommendation to buy or sell any instrument. You alone decide whether, how and at what size to trade, and whether to automate anything.
Risk notice. Futures trading involves substantial risk of loss and is not suitable for every investor. You can lose more than you expect, and you are solely responsible for your own trading decisions and results.
Hypothetical results. The results shown on our website and on TradingView come from backtests or, for trades marked Forward on a strategy page, from the strategy running in real time on TradingView with simulated fills. None come from trading real money. Backtests are prepared with the benefit of hindsight, cannot fully account for fills, liquidity, market impact or the effect of real money on decisions, and each Strategy's settings were chosen using part of the same history. Past results, real or hypothetical, do not predict future results. The prop firm simulator on our website is for information only and is not a forecast of any evaluation's outcome.
Free indicators
We also publish free indicators on TradingView, such as Atlas IB and Atlas Sessions. They cost nothing, need no subscription, and are provided "as is"; we may change or withdraw them at any time without notice. They remain our property: you may use them on your own charts, but may not copy, decompile, extract or resell them or their output as a product or service. Section 8 applies to them, as do TradingView's own terms. They show historical statistics only and are not advice; unlike the Strategies, they produce no entries, exits or alerts.
2. Requirements and access
- You need a TradingView account. You must give your exact TradingView username at checkout; access is granted to that username. Webhook alerts, and longer backtest history, may need a paid TradingView plan.
- Each subscription covers one Strategy for one TradingView username. Access is personal and non-transferable. You may not share, resell or otherwise provide access to anyone else.
- We grant access after checkout, normally within a few hours and in any case within one business day.
- TradingView is an independent platform. We are not affiliated with TradingView or CME Group, and we are not responsible for TradingView outages, data or account issues.
3. Billing and cancellation
- There is no free trial. Subscriptions are billed every 4 weeks in advance, at the price shown at checkout, starting on the day you subscribe, until cancelled.
- Payments are processed by Stripe as merchant of record (Stripe Managed Payments). Stripe is the seller of record for your purchase, and your purchase is also subject to Stripe's consumer terms. Prices are shown exclusive of tax; applicable taxes (such as VAT or sales tax) are calculated and collected by Stripe at checkout based on your location. The charge appears on your card statement as LINK.COM* ALGOTRADERNQGC, because Stripe's managed payments service (branded Link) is the merchant of record.
- Access for each paid period runs to the Friday on or after the period's end date. This gives you up to six extra days at no charge.
- You can cancel at any time from the billing portal linked in your receipt emails. Cancellation stops future charges; access continues to the Friday on or after the end of the period already paid for, then ends.
- If a renewal payment fails, access continues to the Friday on or after the renewal date while the payment is retried. If payment has not succeeded by then, access is removed. It is restored when payment succeeds.
- Founding price. The first 25 subscriptions to each Strategy are billed a founding price, currently $25 every 4 weeks; later subscriptions are billed the higher price shown at checkout. Prices, including founding prices, can change under the term below, but the founding price will always stay below the standard price for the same Strategy. If a founding subscription ends and you subscribe again later, the price shown at checkout then applies.
- We may change prices with at least 30 days' notice. A change applies from your first billing date after the notice period. If you do not agree, cancel before it takes effect.
4. Refunds and your right to cancel
- Each Strategy page shows its full backtest, trade by trade, so you can evaluate it before subscribing.
- Access is digital and is supplied as soon as we add your username. By completing checkout you ask us to supply it immediately, and you acknowledge that, where the law allows, you lose the statutory 14-day right to cancel once access has been granted.
- Fees already charged are non-refundable, except where a refund is required by applicable law, or where the Service was materially unavailable because of a fault on our side, in which case contact us and we will put it right or refund the affected period.
- Nothing in these Terms affects your statutory rights that cannot be waived.
5. Automation and third-party services
- Alert messages are provided for your convenience, in the format of third-party services such as PickMyTrade. We do not operate, control or support those services, your broker, or your prop firm, and we are not responsible for how they receive, interpret or execute orders.
- Automated trading can fail or behave unexpectedly because of connection problems, bridge or broker behaviour, contract rolls, platform changes or settings you choose. You are responsible for configuring, testing and monitoring any automation, and we strongly recommend running it on a demo account first.
- A TradingView alert keeps the version of a script that was current when the alert was created. After we publish an update, you must re-create your alerts to use it.
- Prop firm rules differ between firms and change over time. Some firms restrict automated trading, third-party or purchased strategies, or trading the same signals as other traders. Checking that your trading complies with your firm's rules is your responsibility, and we are not responsible for any account restriction, refused payout or closure that results from using a Strategy with a firm whose rules do not allow it.
6. Intellectual property and acceptable use
- The Strategies, their code, rules, settings and related materials remain our property. Your subscription grants a personal, non-exclusive, non-transferable licence to use the subscribed Strategy on your own TradingView account.
- You may not copy, decompile, reverse-engineer, extract, or systematically harvest a Strategy's logic or output, or republish or resell its signals, alerts or results as a product or service.
- If you submit a review, you allow us to publish it on our website, unedited, with your display name and the month your subscription started. You can ask us to remove it at any time. We publish genuine reviews whether positive or negative, and we never offer anything in exchange for a review.
- We may suspend or end access for a breach of these Terms. Where the breach is sharing, harvesting or resale, this may be immediate and without refund.
7. Changes to Strategies and availability
We maintain the Strategies and may publish updates, which can change the trades a Strategy takes. We will announce updates and will not materially reduce the core functionality described at the time of your purchase during a paid period. We may withdraw a Strategy with at least 30 days' notice; if we do, its subscriptions will not renew. The Service depends on TradingView; interruptions outside our control may occur.
8. Liability
To the maximum extent permitted by law: the Service is provided "as is"; we exclude all implied warranties; we are not liable for trading losses, missed or unexpected trades, failed or erroneous automation, prop firm evaluation or account outcomes, loss of profit, or indirect or consequential loss; and our total liability arising out of the Service in any 12-month period is limited to the amounts you paid us in that period. Nothing in these Terms excludes liability that cannot lawfully be excluded (including for fraud).
9. General
- These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory consumer law in your country of residence provides otherwise.
- We may update these Terms. Material changes will be notified by email or on this page at least 14 days before they take effect. Continued use after that constitutes acceptance.
- If any provision is found unenforceable, the rest remains in effect.
